By accessing, browsing, downloading, installing, or using MORAI, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not use MORAI.
These Terms apply to the MORAI website located at https://moraiphoto.com, the MORAI mobile application, and all related features, content, tools, and services made available by Codvia Teknoloji A.Ş.
2. Description of Service
MORAI is an AI-powered creative platform that allows users to upload images and generate or enhance photo and video content using artificial intelligence tools and visual transformation technologies.
Features may include, without limitation:
- AI photo generation and enhancement;
- AI video generation and animation;
- templates, filters, visual effects, and restoration tools;
- creative editing and style transformation tools;
- related support, account, and website services.
MORAI is intended for lawful creative, personal, and entertainment-related use unless otherwise expressly permitted.
3. Eligibility
You may use MORAI only if you are legally capable of entering into a binding agreement under applicable law.
MORAI is not intended for children under the age of 13. If you are under the age of majority in your jurisdiction, you may use MORAI only with the involvement and permission of a parent or legal guardian where required by law.
4. Accounts and Access
Certain MORAI features may require you to create an account or provide information to access the service. You agree to provide accurate, current, and complete information and to keep such information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, to the extent permitted by law.
5. Acceptable Use
You agree not to use MORAI to:
- violate any applicable law, regulation, or third-party right;
- upload, generate, distribute, or use unlawful, infringing, deceptive, hateful, abusive, obscene, or harmful content;
- impersonate another person or misrepresent affiliation, identity, or authorization;
- create content that violates privacy, publicity, copyright, trademark, or other intellectual property rights;
- attempt to bypass technical limitations, rate limits, security systems, subscription controls, or moderation features;
- interfere with or disrupt MORAI, its infrastructure, or connected networks;
- use scripts, bots, crawlers, or automated means to access the service without authorization.
6. User Content
You may upload photos, prompts, text, and other materials through MORAI (“User Content”). You retain ownership of your User Content, subject to the rights you grant under these Terms.
By submitting User Content, you represent and warrant that:
- you own or control all necessary rights to submit and use that content;
- your User Content does not violate any law or third-party rights;
- you have secured any required permissions from persons depicted in uploaded images;
- your User Content complies with these Terms and all applicable policies.
You grant Codvia Teknoloji A.Ş. a limited, non-exclusive, worldwide license to host, store, reproduce, process, transform, transmit, and display your User Content solely as reasonably necessary to operate, provide, maintain, secure, and improve MORAI and its requested features.
7. AI-Generated Content
MORAI uses artificial intelligence and automated systems to generate, animate, enhance, restore, stylize, or otherwise transform visual content.
- Results may vary based on the image, prompt, input quality, system conditions, and feature limitations.
- Generated content may not be accurate, complete, realistic, unique, or suitable for any specific purpose.
- You are solely responsible for reviewing and evaluating any AI-generated output before using, publishing, licensing, sharing, or relying on it.
- You assume all responsibility for your use of generated content and for ensuring that such use complies with law and third-party rights.
8. Payments and Subscriptions
Some MORAI features may require payment, subscription, or in-app purchase. Prices, plans, features, trial periods, and renewal terms may vary and may be shown in the app or through the applicable app marketplace.
- Purchases made through app stores are subject to the billing and refund policies of the relevant platform.
- You are responsible for reviewing all pricing and renewal details before completing a purchase.
- Unless otherwise stated, subscriptions may renew automatically until cancelled through the applicable platform or settings.
- Failure to pay or maintain an active subscription may limit or prevent access to certain premium features.
9. Intellectual Property
MORAI and all related software, code, design, interface elements, branding, graphics, workflows, models, features, and other content provided by Codvia Teknoloji A.Ş., excluding your User Content, are owned by or licensed to Codvia Teknoloji A.Ş. and are protected by intellectual property and other applicable laws.
No ownership rights are transferred to you. Except for the limited right to use MORAI under these Terms, all rights are reserved.
10. Third-Party Services
MORAI may rely on or integrate with third-party services, platforms, cloud providers, payment processors, analytics providers, app stores, or other infrastructure providers.
We are not responsible for third-party services, content, billing systems, policies, or websites that are not operated by us. Your use of those services may be subject to separate terms and privacy policies.
11. Suspension and Termination
We may suspend, restrict, or terminate your access to MORAI, in whole or in part, at any time, with or without notice, if we reasonably believe that:
- you violated these Terms or applicable law;
- your use creates risk, harm, legal exposure, or technical burden for MORAI or others;
- we are required to do so by legal, regulatory, or platform obligations;
- continued operation of the service or a feature is no longer commercially or technically feasible.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MORAI IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
CODVIA TEKNOLOJİ A.Ş. DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RELIABILITY.
We do not warrant that the service will be uninterrupted, error-free, secure, or that outputs generated through MORAI will meet your expectations or requirements.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODVIA TEKNOLOJİ A.Ş. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF MORAI.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF CODVIA TEKNOLOJİ A.Ş. FOR ANY CLAIM ARISING OUT OF OR RELATING TO MORAI SHALL NOT EXCEED THE GREATER OF:
- the total amount paid by you for MORAI in the 12 months before the claim arose; or
- USD 100.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Codvia Teknoloji A.Ş. and its affiliates, directors, officers, employees, contractors, licensors, and service providers from and against any claims, actions, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your use or misuse of MORAI;
- your User Content;
- your violation of these Terms;
- your violation of any law or third-party rights.
15. Changes to These Terms
We may update or modify these Terms of Use from time to time. When we do, we may revise the effective date and provide notice where required or appropriate.
Your continued use of MORAI after updated Terms become effective constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of Türkiye, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or your use of MORAI shall be subject to the jurisdiction of the competent courts and enforcement offices of Antalya, Türkiye, unless otherwise required by mandatory consumer law.
